These Terms of Use ("Terms") govern your use of the Thrive Wellness website, online store, and any purchase from Thrive Wellness FL, LLC ("Thrive Wellness," "we," "us," or "our"), including purchases at our store at 1107 W North Blvd, Suite 1, Leesburg, FL 34748. By using our website or buying our products, you agree to these Terms. If you do not agree, please do not use our website or purchase our products.

1. Eligibility and Age Requirement

You must be at least 21 years of age to purchase hemp-derived products from Thrive Wellness, online or in store. We verify age at the point of sale and upon delivery, and we may cancel any order where age cannot be verified. By placing an order, you confirm that you are 21 or older and that purchasing and possessing our products is lawful where you live.

2. Hemp Regulatory Notice and Changes in Law

Thrive Wellness sells hemp-derived products that, at the time of sale, comply with the federal definition of hemp and with Florida law, and every product is tested by an independent, third-party laboratory. Certificates of Analysis (COAs) are available for our products on request and through the QR codes on our packaging.

The laws governing hemp are changing. In November 2025, Congress amended the federal definition of hemp to measure total THC (including THCA) and to limit finished hemp-derived cannabinoid products to 0.4 milligrams of total THC per container. Most of those changes are currently scheduled to take effect on December 11, 2026, and Congress may delay, amend, or replace them before or after that date. Florida may also change its own hemp laws in response.

Because of these changes, the products, cannabinoids, potencies, and formats we offer may change with little or no notice. We reserve the right to discontinue any product, cancel or refund any pending order, limit quantities, or stop selling or shipping certain products to certain locations at any time in order to comply with federal, state, or local law. If we cancel an order for this reason, we will refund the amount you paid for the canceled items, and this refund is your sole remedy.

You are responsible for knowing and following the laws that apply to you, including laws governing possession and use of hemp-derived products where you live or travel. Thrive Wellness does not provide legal advice, and nothing on our website or in our store is a statement that any product is legal in your location. We will continue to monitor these developments and will update our product offerings and these Terms as the law requires.

3. FDA Disclaimer and No Health Claims

These statements and products have not been evaluated or reviewed by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

Thrive Wellness makes no claims that any product provides any health, medical, or therapeutic benefit. Any information on our website, packaging, social media, or provided by our staff is for general educational purposes only and is not medical advice. Individual experiences vary. Consult a qualified healthcare provider before using any hemp-derived or functional mushroom product, especially if you are pregnant or nursing, take any medication, or have a medical condition.

Hemp-derived products may cause impairment. Do not drive, operate machinery, or engage in hazardous activities after use. Hemp-derived products may cause a positive result on a drug test. Keep all products out of the reach of children and pets.

4. Products, Pricing, and Orders

We make reasonable efforts to describe our products and display their prices accurately, but we do not guarantee that descriptions, images, cannabinoid content, or prices are error-free. Lab results reflect the tested sample and may vary naturally between batches. We may correct errors, change prices, and refuse or cancel any order at any time, including after you receive an order confirmation. If we cancel an order after you have been charged, we will refund the charge.

5. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR WEBSITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THRIVE WELLNESS DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT A PRODUCT WILL PRODUCE ANY PARTICULAR RESULT OR EFFECT. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THRIVE WELLNESS AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OUR WEBSITE OR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS, OUR WEBSITE, OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

7. Assumption of Risk and Indemnification

You use our products voluntarily and at your own risk. You agree to indemnify and hold harmless Thrive Wellness and its members, managers, employees, and agents from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of any product, your violation of these Terms, or your violation of any law.

8. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by applicable federal law.

9. Dispute Resolution

Informal resolution first. Before filing any claim, you agree to contact us at info@thrivewellnessfl.com with a description of the dispute and give us 30 days to try to resolve it informally.

Binding arbitration. Any dispute not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Lake County, Florida, or by video conference. Either party may instead bring an individual claim in small claims court in Lake County, Florida, if the claim qualifies.

Class action waiver. You and Thrive Wellness agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Venue. For any matter not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Lake County, Florida.

10. Changes to These Terms

We may update these Terms at any time by posting the revised version on our website with a new effective date. Your continued use of our website or purchase of our products after that date means you accept the updated Terms.

SMS / Text Messaging Terms

This section is separate from, and does not change, the Terms above. It applies only if you choose to receive text messages from Thrive Wellness.

• Express consent. By checking the text-message box on our sign-up form and giving us your mobile number, you expressly agree to receive recurring automated marketing and informational text messages from Thrive Wellness FL, LLC at that number, including messages sent with an automatic telephone dialing system.
• Not a condition of purchase. Consent to receive text messages is not required to buy any product or use our website.
• Message frequency varies. The number of messages you receive will vary.
• Message and data rates may apply. Your mobile carrier's standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• Opt out at any time. Reply STOP to any message to stop receiving texts. We will send one message confirming that you have opted out, and then no more marketing texts unless you sign up again.
• Help. Reply HELP for help, or email info@thrivewellnessfl.com.
• Adults 21+ only. Text messages are for adults 21 and older. Do not sign up if you are under 21, and use only a mobile number that belongs to you.
• Your number is not sold or shared. We do not sell your mobile number or share it with third parties for their marketing. See the SMS section of our Privacy Policy.
